    Big fines for data loss and/or breach...

    BBC News - Data losses to incur fines of up to £500,000

    According the the beeb. I'm wondering if this may also affect the various cloud providers who have been blighted with issues over the last 12 months?

    Yeah, I think when they say data loss they mean leaving a laptop on a train/in a taxi or posting the CD/DVD/HDD and it never turning up, rather than accidentally destroying all your customer's data.

    That's what I thought initially but was thinking a little further and wondered how far they would go with legislation.

    Cloud Providers

    This defintely affects Cloud Providers. If a client company is going to be sued/fined due to a breach occuring on your servers you can bet your bibby they are going to come after you for compensation - it doesn't matter what your agreement says.

    In the US and in Europe Cloud Providers have a legal requirement to protect data, this and other items of interest coming out of the Madrid Conference add weight that providers heads are on the chopping block if breaches occur.

    Days of cheap hosting are well and truly over!

    I think you are confusing data loss (someone stealing it) with data loss (hard drives going kaput, no backups etc). I can't ever see a government legislating against people losing data into the ether.

    Data into the ether

    When it comes to Personal Data they are - it is a global trend. The UK now has the right to impose fines of up to UKP 500,000 and the OIC (I think they are called) are shooting for jail time

    ICO not OIC

    Losing personal data through incompetence or negligence yes.

    Not through not having backups or hard drives blowing up etc.

    It's about the idiots losing laptops with a banks customers details on and other idiots like that.

    Yes, but what Mark is saying is; is that for exposing people's sensitive data, or is it for accidentally destroying it?
    The ICO now has the power to fine up to £500k for breaching the Data Protection Act (i.e. if they store data about me and then leave it lying around where everyone can find it) but they can't fine a cloud provider storing my data if that provider accidentally deletes it.
