I have 2 Windows server 2003 r2 licenses (used) that I no longer require. Is it legal to sell them? They are boxed with the original discs and keys.

Are they OEM? If so they cannot be sold.

Boxed OEMs? Actually you might be right - we had a colo punter telling me he had boxed OEM 2008 Web he wanted to sell us along with his server seeing as he was pulling out - in fact he wanted us to take the server in lieu of payment (which is in the contract, right of lien over his equipment if he doesn't pay) and then pay him the difference... I've suggested BACS will be fine for March plus Apr (notice period) and he can keep his server/watchguard + "licenses" - Oh and if anyone wants a quad core micro server (tower) Dell thingy with 4gig mem plus R1 disks and a Watchguard 550, he is flogging them... I can point you in his direction... Personally, I will be happy to relieve 4U of space occupied by said server+red lan switch/firewall thingy

No they are not OEM, so can they be resold as used? as the servers they were installed on are no longer in use, and never will be.
